Which Side of the Fence Is Mine?

For some reason, there’s a thought that each homeowner has a designated side of the fence to take care of. 

Unfortunately, this isn’t true. 

So, if you’re questioning which fence is mine: left or right? There is a way to discover which side is yours. 

You may be able to find out which side of the fence belongs to you within your home ownership paperwork or the solicitor who conveyed your home. To know for sure though is getting access to the Title Deeds on the Land Registry

(It’s important to note you may need to pay a small fee to access these documents.)

When you get your documents, you should see either of two shapes: 

  • A T-mark 
  • An H-space

If you see a T on your side of the fence this means that the fence belongs to you as it is within your boundary. If it is in your neighbours, the fence belongs to them.

If there is an H-shape instead, it means that both owners are responsible for the fence. 

Can I Tell Which Side of the Fence Is Mine Just By Looking?

You can sometimes tell which side of the fence is yours by looking. But you need to know what to look for. 

The Frames

Typically, when builders or house owners are installing fences, it is done in a way that faces away from the property. This is so that they get what is deemed the ‘good’ side of the fence - also known as the side of the fence with no posts. 

So, if you do have the fence frames on your side, it is likely that the fence belongs to your neighbour. 

Of course, this isn’t 100% accurate, and because of this we recommend talking to your neighbours before you make any changes to your side of the fence, such as painting your fence. 

There’s an Issue with the Fence, Who Should Repair It?

A continuous issue neighbours face is: Who repairs the fence when it is damaged?

As you may unfortunately know, it’s not always straightforward. 

If your neighbour owns the fence, it technically means they should repair any damage. However, it sometimes doesn’t happen this way. 

For example, your neighbour may be dead set on leaving the fence as it is. Sadly, there’s nothing much you can do about that. 

If the fence has fallen down due to strong winds or a storm, and it belongs to the neighbour, they have an obligation to remove it from your property. 

But there’s no requirement to replace the fence unless it poses a safety issue

If you would like to reinstate a fence, you can install one on your property as long as it is within your boundaries. This way, if your neighbour decides they would like to reinstate their fence, you won’t need to have an awkward conversation with them and potentially remove your fence.
